4) Jangan Menggunakan Sentimen Negeri "

Secession is against the constitution, says Anwar

Kota Kinabalu: The Sabah Sarawak Keluar Malaysia (SSKM) campaign will hinder any attempt at forcing the Government to re-look at the original conditions of the Malaysia Agreement 1963.
Parti Keadilan Rakyat (PKR) Adviser Datuk Seri Anwar Ibrahim said there has been growing support for the rights of Sabah and Sarawak and to revisit the spirit of the Malaysia Agreement 1963 but warned that any secession effort would hijack the process.

"It will not benefit us in the long run. Seceding from the Federation is against the Constitution. States are integral parts of the Federation. It is clearly stated. Do not use this State sentiment because no country in the world would readily concede this argument.

"And particularly when it represents a minority, I think we have to be careful as it will be used against the rest," he said, at a press conference after holding a dialogue with a group of youths, here, Friday.

Thus, any attempt to secede from the Federation is unreasonable and advised Sabahans to effect change instead of submitting themselves to a new independent state.

He added that from his meetings with people from different groups in Sabah and Sarawak, it appeared that the people are more disenchanted because of the neglect, marginalisation, poverty and inequality they suffered.

Anwar said he agreed with many of the concerns expressed and that major transformation of the national policies is required. "Just because I disagree with SSKM does not mean that I disagree with the clamour for reform in Sabah. People tend to think that if you disagree with SSKM, that means you do not like the wishes of Sabahans.

"That is not true. Look at my speeches in Parliament. I am from Penang but I am tough on Sabah and Sarawak rights although we did not get the support here.

"It does not matter…because when it comes to principles and rights, we must stand our ground," he said.

Anwar branded the SSKM movement a populist move and that its objective runs against the constitution.

Anwar also said he is resigned to accepting whatever the outcome of the appeal on his second sodomy conviction.

If the appeal is dismissed, Anwar would immediately serve five years' imprisonment and effectively lose his Permatang Pauh parliamentary seat as the law bars anyone fined RM2,000 or imprisoned for one year from serving as a lawmaker.

"Do not expect me to negotiate my principles. I will not accept any ultimatum. There is no reason whatsoever, based on the evidence and the law, that can implicate me in committing the offence.

"So what is the problem? I deserve to be acquitted. But in the event I am convicted, it will certainly not be easy for me, Azizah and the family because of my age and my condition, to be sent back to prison.

"It is a political decision. It is not an issue of legal evidence. Nobody can dispute that, except (prosecutor) Tan Sri Muhammad Shafee Abdullah of course," he said.

Anwar added that while he prayed that he would be acquitted, an imprisonment sentence will not deter his struggle and he will carry on with his pre-arranged plans ahead of the Feb. 10 decision.

In terms of party leadership, he said his wife Dato' Seri Dr Wan Azizah Wan Ismail will remain the president of PKR and assisted by a team of very capable and effective leaders, including Selangor Menteri Besar and PKR Deputy President Azmin Ali.

"As a team, we have prepared the ground well. I have discussed it extensively even with my fellow members of Pakatan Rakyat although we are still having some difficulty with setting the date for the meeting with PAS.

"But otherwise, our agenda and policies must be respected," he said.

TOLAK PARTI-PARTI MALAYA!

Jeffrey: Asean must help Sabah, Sarawak

Asean can do more in the region similar to the European Union (EU) which takes an interest in human rights.

KOTA KINABALU: Bingkor Assemblyman Jeffrey Kitingan has called on Asean Foreign Ministers, meeting in a retreat in Kota Kinabalu on Tuesday and Wednesday, to consider the plight of Sabah (and Sarawak) in Malaysia “and politely ask their hosts about it”.

“As the Malaysian Foreign Minister is from Sabah, perhaps a private session will throw better light on Sabah issues, for example, and problems from the Sabah perspective,” said Jeffrey in giving his take on the Asean meet.

“Their diplomatic questions could be of assistance to the original inhabitants of Sabah and bring about a review of the Malaysia Agreement or a referendum for self-determination under the auspices and supervision of the United Nations and Asean.”

Asean can do more, added Jeffrey, similar to the European Union (EU). “In the modern era, no nation should stand idle and watch from afar the mistreatment of fellow humankind in another country.”

The political franchise of the indigenous natives in Sabah, alleged Jeffrey, had been usurped by illegal immigrants who were given dubious identity cards by the Malaysian government and given instantaneous rights as Malays with Bumiputera privileges to the detriment of the indigenous natives.

”No ethnic group, including Malays, can claim a better right to their motherland in Sabah than the indigenous natives in Sabah,” said Jeffrey who is also Star Sabah Chief.

“The once-majority indigenous natives have been reduced to a minority and marginalised.”

He lamented that from being the second richest in the 1970s, Sabah is now the poorest state in Malaysia with the majority of the poor being the indigenous natives. “Its rich resources including petroleum and gas and its revenues are almost 95 per cent to 100 per cent taken by the Federal Government to fund development in the peninsula”.

For the past 51 years, he continued, the basis of the Malaysia Agreement has not been complied with and elsewhere eroded by the Federal Government through its proxy hold on the Sabah and Sarawak Governments.

”The rights and autonomy of Sabah have slowly but surely been eroded and whittled down by the Federal government which to us in Sabah is nothing more than the Federal Government of Malaya masquerading as the Federal Government of Malaysia,” said Jeffrey in a reference to the definition of Federation in Article 160 of the Federal Constitution.

“From a once proud nation equal to the Federation of Malaya, Sabah has now been down-graded to being the 12th state in Malaya while Sarawak is the 13th state.”

Elsewhere, he said, the Federal Government has now even threatened to amend the colonial-era Sedition Act to make it seditious and a criminal act for anyone to voice the rights of Sabah and Sarawak in the Federation.

“This is the extent of the dictatorial regime of the Federal Government to stifle the voices, grievances and legitimate claims of Sabahans and Sarawakians instead of it being a Federal Government of equal partners as envisaged in 1963,” he said.

Yong Teck Lee wins appeal; gets refund and costs

By Ranau Sativa

KOTA KINABALU: The Court of Appeal here today allowed with costs an appeal by Sabah Progressive Party (SAPP) and its President Datuk Yong Teck Lee to set aside the High Court’s verdict for ordering SAPP and Yong to pay Tan Sri Harris Salleh RM1 million in damages for defamation over the “Double Six” tragedy that killed the then Chief Minister Tun Fuad Stephens and ten others on board of a crashed Nomad aircraft on June 6, 1976.

Justice Datuk Linton Albert, who sat together with Justices Dato’ Anantham Kasinather and Dato’ Seri Zakaria Sam, unanimously allowed the appeal with RM150,000 costs to be paid to the appellant.

The court also ordered Harris, who was the respondent, to refund the entire amount which had been paid by the appellant to him within two weeks.

The High Court judge Datuk Abdul Rahman Sebli had on February 29, 2012, ordered SAPP and Yong to pay Harris RM1 million in damages for allegedly insinuating that he (Harris) was involved in causing the “Double Six” Tragedy that killed Fuad Stephens and 10 others on board the Sabah Air plane about 37 years ago in Sembulan.

In his judgment, Abdul Rahman held that Yong had “crossed the line” when he insinuated that Harris had “blood on his hand” though, he added, there was nothing wrong for Yong to call for a re-investigation of the air crash.

He also found that the use of the words “crime” and “assassination” by Yong were defamatory to Harris and had provoked speculation that Harris knew in advance that something sinister was going to happen to the aircraft and that he had left Tun Fuad Stephens to die so that he could take over as the chief minister of Sabah.

Harris had filed the suit on June 6, 2011, against SAPP and Yong through his counsel Yunof Maringking, claiming general damages, aggravated and exemplary damages of not less than RM50 million from Yong who was named as first defendant and SAPP as the second defendant.

He is also sought an injunction to restrain the defendants, whether by themselves or their servants or employee or agents from printing and publishing further, the statements and similar libel in any form or means.

Yong was represented by counsel Datuk Simon Shim.

Sabah lawmaker to push for special committee to review Malaysia Agreement

PKR's Darell Leiking says if Parliament had allowed a Special Committee be established earlier to hear the opinions of nationalist groups from Sabah and Sarawak, there will be no talk of secession now.

KOTA KINABALU, Jan 26, 2015: A Sabah lawmaker is urging fellow parliamentarians to support a proposal to establish a special committee to review the Malaysia Agreement 1963.

Penampang Member of Parliament Darell Leiking, in making the call, said he would be resubmitting a motion for the setting up of the committee when Parliament convenes.

Leiking first submitted the motion in Parliament two years ago, but it was rejected as it was not considered an urgent matter.

He was responding on the Attorney-General Tan Sri Abdul Gani Patail’s recent statement on the position of Sabah within the Federation of Malaysia.

Gani also called for a proper and rational discussion as to whether all the safeguards intended to protect the interests of East Malaysian states, prior to formation of Malaysia, had been properly observed.

Leiking said it was important to attend to the root causes as to why disgruntled Sabahans and Sarawakians were talking about secession these days.

The PKR politician believed the current discontent was due to sentiments that Sabah and Sarawak had been grossly marginalised all these years.

With the A-G’s suggestion for discussion on the issue, Leiking said there was an urgency to take another look at the Malaysia Agreement 1963, especially when there were so many issues being raised by Sabah and Sarawak nationalists.

“By doing so, we will be able to conclude whether the Federation of Malaysia today is what Sabah and Sarawak had aspired it to be in 1963.”

Leiking pointed out that more Sabahans were now talking about the marginalisation of Sabah, with some local politicians even complaining about the state’s poor conditions in their speeches during the tabling of the federal Budget in Parliament.

“If Sabah’s BN MPs themselves are complaining, what more of the ordinary Sabahans on the street?
“So how could the BN-led federal government be oppressive towards the ordinary Sabahans who are merely voicing out their displeasure with how Sabah is being treated?”

He said the establishment of this Special Committee, which was promised to be formed every 10 years from the date of formation of Malaysia, would have been able to conduct the review and ascertain which parts of the Malaysia Agreement 1963 and its Annexures had not been fulfilled or performed.

Had Parliament allowed the Special Committee be established in the first place and let the opinions of these nationalist groups from Sabah and Sarawak be heard through this committee, Leiking said he was certain that there would be no talk of secession now.

“Unless it is the intention of West Malaysia to colonise Sabah and Sarawak, let me state here that being equal partners, no one is higher than Sabah and Sarawak.

“Surely not even the federal government, since without Sabah and Sarawak, there will be no federal government in the first place.”
